By using Shotfax (the "Service") you agree to these terms. They are short on purpose.

0.Who you are contracting with

The Service is operated by Povilas Konopackas, registered as an individual activity under certificate (individualios veiklos pažyma) in Lithuania, EU. Contact: support@shotfax.com. Payments are processed by Stripe; the seller is Povilas Konopackas (Shotfax) and your card statement will show SHOTFAX.COM. For purchases completed before 12 July 2026, Polar Software Inc. acted as merchant of record and those statements show POLAR * SHOTFAX.

1.Service description

Shotfax is a pay-per-use fax delivery service. You upload a document, provide a destination fax number, and pay a fee. We attempt to deliver the document via fax through our delivery partner Telnyx.

3a.EU right of withdrawal

Consumers resident in the European Union normally have 14 days to withdraw from a distance service contract under Directive 2011/83/EU (Consumer Rights Directive). Shotfax is a digital service that begins performance as soon as you pay and your fax is queued for transmission.

By ticking the acknowledgment box on the upload form and clicking "Send fax," you expressly request that Shotfax begin performance immediately and you acknowledge that, under Article 16(m) of Directive 2011/83/EU, your right of withdrawal is lost once the fax has been successfully delivered. If the fax fails, the automatic refund under section 3 applies regardless.

4.Acceptable use

You agree to:

Every fax is stamped with a header carrying the transmission date and time, the sender name you provide, and a sending phone number, as required by US law (47 U.S.C. 227(d)). You are responsible for the accuracy of the sender name you enter. At checkout you certify that the recipient has consented to receive the fax or that you have an established business relationship with them.

Shotfax enforces a daily per-sender volume limit and does not provide, sell, or suggest recipient fax numbers. On receiving a credible complaint that a sender is violating this section (for example, a TCPA junk-fax complaint), Shotfax may refuse further service to that sender and block their transmissions without notice. Completed sends are not retroactively refundable under this clause.

5.HIPAA and PHI

Shotfax is a general-purpose document transmission service. It is not a HIPAA-compliant service, and Shotfax does not sign Business Associate Agreements. If you are a HIPAA covered entity or business associate, do not use Shotfax to transmit Protected Health Information. A patient sending their own health records on their own behalf is not acting as a covered entity and is not restricted by this clause, but does so under the same best-effort and no-warranty terms as any other document.

5b.No government or agency affiliation

Shotfax is an independent private service. It is not affiliated with, endorsed by, or acting on behalf of the Internal Revenue Service (IRS), the Social Security Administration, or any other government agency, court, or authority. Any reference to such an agency or to a destination fax number is provided only to help you reach a recipient you have chosen. Shotfax transmits your document to the fax number you supply; it does not confirm that the receiving agency has received, accepted, or processed your submission, and it does not file anything on your behalf. You are responsible for confirming receipt and meeting any filing deadline directly with the recipient.

6.Limitations

7.No warranty

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. Shotfax disclaims all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that delivery will succeed, that it will occur within any timeframe, or that the receiving fax line will be available, answer, or correctly receive the transmission. Timing statements on the site (for example "usually in about a minute") describe typical results and are not guarantees. This clause does not reduce statutory consumer rights that cannot be waived by contract.

7a.Limitation of liability

To the maximum extent permitted by law, Shotfax's total liability for any claim arising from your use of the Service is limited to the amount you paid for the specific transaction in question. We are not liable for indirect, incidental, special, punitive, or consequential damages including missed deadlines, penalties, interest, lost data, legal or tax consequences of delayed, failed, or non-delivery, or business losses, even if advised of the possibility of such damages. Nothing in these terms limits liability that cannot be limited under applicable law, including liability for gross negligence, willful misconduct, or death or personal injury caused by negligence.

7b.Indemnification

You agree to indemnify and hold harmless Shotfax and its operator from any third-party claim, loss, liability, or expense (including reasonable legal fees) arising directly from: (a) the content of the documents you transmit; (b) your violation of these terms; or (c) your violation of any applicable law or a third party's rights. This indemnification does not cover losses caused or contributed to by Shotfax's own acts or omissions, and does not reduce or waive any statutory consumer rights that cannot be limited by contract.

8.Service availability

We aim for high uptime but do not guarantee uninterrupted service. The Service depends on Cloudflare and Telnyx, which may experience downtime outside our control.

9.Changes

We may update these terms. Material changes will be posted on the site at least 30 days before taking effect.

10.Governing law

These terms are governed by Lithuanian law. EU consumers retain the mandatory protections of their country of habitual residence under Article 6 of Regulation (EC) 593/2008 (Rome I). Nothing in these terms reduces statutory consumer rights that cannot be waived by contract.
